Bellatrix First Aid Training Courses - Terms and Conditions

 

Definitions

Attendee(s) – Any individual or individuals attending a course or receiving services directly from Bellatrix First Aid Training.

Bellatrix –Bellatrix First Aid Training is the trading name for Bellatrix Health and Safety Limited, registered in England and Wales, company number 7588024, registered address 18 The Broadway, Stoneleigh, Ewell, Epsom, Surrey KT17 2HU, email info@bellatrixfirstaidtraining.com, the supplier of services. 

Candidate(s) - Any individual(s) attending a course or receiving services directly from Bellatrix.

Client – Any company or person that purchases services from Bellatrix.

Charge(s) – Bellatrix charges in place and as agreed with the Client.

Consumers – not those acting in the course of a business.

Contract – The contract between Bellatrix and the client incorporating these terms and conditions.

In-House Course – A course run by Bellatrix for a single client usually at premises owned, managed or hired by the client.

Materials – Any books, documents, handout, training dressings, bandages supplied by Bellatrix to another relating to the service.

Open Course – A course run by Bellatrix and open for more than one client at premises not owned or managed by the client.

Service(s) – First Aid Course(s) offered to the client by Bellatrix First Aid Training.

Terms – These general terms and conditions that apply to the provision of any service and supersede any other terms and conditions.

We/Us – As for Bellatrix.

Quotation

Bellatrix are happy to supply a written quotation upon request.  All quotations are valid for 90 days after which they may be subject to change.  Note that any dates agreed in your quotation are only provisionally reserved until full payment is made.  

 

Booking a course/Group bookings

Initial booking enquiries may be made via letter, telephone or email.  However, all course bookings require the completion of a Course Booking Form, signed and dated by an authorised company representative (or private individual if self-funding) and returned.  Any fault with the supplied postal or email address or telephone number will delay your booking.  

 

We offer a Group Booking facility for some courses that are usually offered at discounted rates.  The booking fees are calculated on the basis that the client agrees with Bellatrix in advance, a set number of candidates for the course.  The client is therefore responsible for securing the attendance of the agreed number of candidates.  The course fee remains the same regardless of the final number of candidates trained up to the agreed figure.  Additional candidates will attract an additional fee.    

 

Bellatrix and the client shall agree times and places for the performance of Services which shall generally be set out in the relevant booking form. Otherwise, Bellatrix shall use its reasonable endeavours to perform them within a reasonable time in the circumstances and time is not of the essence of the contract.

 

Note: some courses can only be run ‘in-house’ at a client’s premises and or require a minimum number of candidates to run.  We will make you aware of which courses this applies to. 

 

 

Acknowledgement of your booking and contract between us

The receipt of a signed booking form represents an offer on your part to purchase services which will be accepted by us only when a confirmation of booking letter is sent by us.  On written confirmation of a booking or on the date of invoice, only at this point is a legally binding contract created between us.  All bookings will be confirmed by email or letter within 14 working days but only after the receipt of a signed booking form.  

 

Payment terms

All fees are payable in advance prior to the course commencing.  Until payment is received in full, bookings are provisional. Payment is due immediately from the invoice date. Note that Bellatrix are not currently registered for VAT.

 

We currently do not accept credit or debit card payment. The preferred method of payment is by BACS (Payment details: Sort Code 08-92-50 Account No. 68193360).  Please quote our invoice reference number as the bank reference and forward a remittance email to Bellatrix at info@bellatrixfirstaidtraining.com.  

 

Cheques are also accepted provided they are received in sufficient time to clear prior to course commencement.  Cheques should be made payable to Bellatrix Health and Safety Ltd quoting our reference number on the back.  The relevant details can be found on our invoices. 

 

Late payment charges of 8% above the Co-Operative Banks’ base rate apply from the invoice date.   Bellatrix reserves the right to cancel or refuse admittance to any course until full payment is received. This does not affect any other rights we may have. We also reserve the right to withhold certificates until full payment has been cleared.

 

Consumer cancellation rights

Where you are a consumer as defined in The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134  you have the legal right to cancel your order up to 14 calendar days after the day on which the contract is entered into (the Cancellation Period).  You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty (unless we have begun the services within the Cancellation Period in accordance with the clause below)

 

Should you wish to cancel your booking, you can use the cancellation form provided at the end of these terms and conditions, or alternatively you can notify us by any other clear statement.

 

If you require us to begin the services within the Cancellation Period we require you to make an express request to do so.  In such cases, your right to cancel continues until either the end of the Cancellation Period, or the completion of the services, whichever is the earlier.  If you cancel during the Cancellation Period we may charge you for any services provided up until the point when we receive your cancellation notice, and will provide a partial and proportionate refund accordingly.  Your right to cancel the services will no longer apply once the services have been fully performed.

 

Company cancellations

If you are booking your course as a company, the full course fee will be charged for cancellations made fewer than 10 working days before the course start date.  Cancellations can be made by telephone (07891 933550) or email (info@bellatrixfirstaidtraining.com). This applies to both scheduled courses and group bookings.

 

Transfer to another course

Transfers must be taken within three months of the original course date and are permitted once only.  Cancellations, changes or transfers of a booking can be made in the first instance by telephone but must be confirmed immediately in writing by post or email.  A booking will only be classed as cancelled once written confirmation has been received from Bellatrix.  Any refunds will be processed as soon as possible and in any event, within 14 days of your cancellation. 

 

Group booking transfers

No charges will be applied to any transfer request that we receive, provided that it is received at least 10 working days before the course start date. Any transfer requests received fewer than 10 working days before the course start date may incur a 50 per cent charge of the course fee.

 

Cancellation or reschedule of courses by us

On occasion, unforeseen circumstances may require us to cancel a course. We reserve the right to cancel, alter the dates of or change the venue of any training course.  In such circumstances you will be given as much notice as possible (usually by email) and offered either a free transfer to another course date or a full refund of any fees paid. We will re-credit to your account any sum paid by you as soon as possible, but in any event within 14 days.  We do not accept any responsibility for certificates expiring as a result of a cancelled course.

 

Employer/individual responsibility

We have an Equal Opportunities Policy.  To help Bellatrix ensure fairness and that candidates needs are met, it is the responsibility of both the employer and or the individual candidate to ensure that notification is made to Bellatrix in advance where possible, of any condition or injury that could hinder the candidate’s ability to participate fully in the course.  Reasonable adjustments can then be considered and implemented where reasonably practicable in order to assist the candidate on the course.

 

Please note that we do not provide any specialist services such as a crèche on site, equipment and/or signers or translators. 

 

Joining instructions

Full joining instructions will be sent out approximately 10 working days before the course.  The client is responsible for ensuring that booking confirmation and joining instructions are received in good time prior to the course.    

 

Failure to attend the course due to not having received joining instructions may result in the full cost of the course being charged.  It is the responsibility of the person booking the course (usually the client) to ensure that each attendee is fully briefed and made aware of these instructions and all course requirements before attending the course.

 

Assessment

If Bellatrix decides that a candidate has not achieved the learning outcomes of the course and/or the assessment standard (e.g. they are referred), then they will subsequently be offered one reassessment that may incur an additional charge. This must be within six weeks from the course start date.  A further second referral may result in a full course retake.  Any further training or coaching over and above that provided on the course may be charged for.

 

Attendance and Lateness

Candidates must attend the whole course in order to meet the required contact teaching hours.  Bellatrix reserves the right to refuse admittance to the course if in their opinion, there is insufficient time left to enable the candidate to gain sufficient knowledge or skill to pass the assessment i.e. late arrival or periods of absence from any session.  In all such cases, full course payment is required except in the event of illness and you provide us with a medical certificate.  To conform with Health & Safety Executive (HSE) requirements for statutory certificates, attendance at all sessions is mandatory.

 

In House Training

The client is responsible for providing a suitable, safe carpeted venue with adequate welfare facilities for candidates and trainers.  The client is also responsible for any other associated costs such as travel, accommodation and refreshments for delegates attending courses.  If in the opinion of the trainer the premises are unsafe or unsuitable, the course may be cancelled. 

 

Photograph Identification

Some courses require candidates to produce photographic proof of identity (i.e. driving licence or passport).  This requirement will be notified to clients as part of the booking process. Failure to provide such evidence will preclude candidates from any assessment.  Full course payment will still be required.  

 

Additional requirements for courses

By its very nature first aid training is intensive.  It can be physically and mentally demanding.  Candidates are expected to take part in activities such as resuscitation using manikins or placing fellow candidates into the recovery position on the floor.  Candidates will need to dress appropriately for these kinds of activities (i.e. flat footwear and trousers).   

 

It is the individual/clients responsibility to ensure that prior to attending the course, all attendee(s) attending a First Aid at Work Requalification course prove that they hold a first aid at work certificate (preferably in date or expired within three months of the due date).    

 

Replacement certificates

Certificates are dispatched within four weeks of course completion. In the unlikely event that four weeks have elapsed and the certificate has still not arrived, please contact Bellatrix.  Lost or damaged certificates will be replaced for a £10.00 administration charge.

We are under a legal duty to supply services that are in conformity with this contract and in accordance with the Consumer Rights Act 2015 (the Act).  Bellatrix warrants to provide Services with all the care and skill to be expected of a qualified and competent contractor experienced in undertaking services of the same kind as the Services.

 

If the Services performed are in breach Bellatrix will at its option make good the performance, re-perform the Service or refund the Purchaser the relevant Price, subject to availability and the performance being proved to be deficient to the reasonable satisfaction of Bellatrix. These obligations will not apply where:

(a) the part of the Service concerned was based on information supplied by or varied from the normal Service at the specific request of the client; or

(b) the client failed to notify Bellatrix of the defect within 14 days of the supply.

 

If you have any queries or concerns about your course you should in the first instance, raise them with your trainer during the course.  If the matter cannot be resolved to your satisfaction, you should raise the matter in writing with Bellatrix Health and Safety Limited.

 

Any formal complaints should be made in writing and be as detailed as possible.  The complaint should be sent via your company management to the ‘Training Manager’ at Bellatrix Health and Safety Limited.  Bellatrix will then conduct a full review of your concerns before making a formal reply, usually within 30 days.  Grievances can also be investigated by Qualsafe Awards at the address shown in the Training Charter document that will be supplied to you at the beginning of the course.   

 

In the event of a dispute concerning the Services the parties shall use their reasonable endeavours to resolve it as soon as practicable.  If they fail to do so within 20 days, the parties shall try to agree on and implement a method of dispute resolution.  If they fail to agree such method within 20 days, the parties confirm that the dispute will then become subject to the exclusive jurisdiction of the English courts.

 

The European Commission has established a web-based platform to allow consumers to submit a contractual dispute arising from the purchase of goods and services.  Further information about this mechanism for resolving disputes can be found at http://ec.europa.eu/consumers/odr/.

 

Liability

Bellatrix cannot be held responsible for any circumstances outside of our control which may affect our ability to fulfil our commitment to you.  Such circumstances include but are not limited to, adverse weather conditions, illness or low numbers of candidates booking onto a particular course.

 

Bellatrix Health and Safety Limited do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues, business interruption, indirect, special or consequential loss or damage, costs, expenses or claims for compensation associated with the cancellation of training courses.

 

Furthermore, we do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or is due to events which are beyond our reasonable control.

 

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.  

 

The entire liability of Bellatrix Health and Safety Limited under or in connection with the course(s) shall not exceed the total charges paid by the client.

 

If we are providing services in your property, we will make good any damage to your property caused by us while doing so. However, we are not responsible for the cost of repairing any pre-existing faults or damage to your property that we discover while providing the services.

 

Bellatrix does not accept liability for any accidents or misuse of training carried out by any candidate after they have completed the course.

 

Force Majeure

Neither party will be liable to the other for any failure or delay or for the consequences of any failure or delay in performance of this Agreement if it is due to any event beyond the reasonable control and contemplation of a party to this Agreement including, without limitation, acts of God, war, industrial disputes, protests, fire, flood, storm, tempest, explosion, an act of terrorism and national emergencies.

 

Contracts (Right of Third Parties) Act 1999

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.

 

Notices

Any demand notice or communication may be given by hand or sent by first class prepaid post and shall be deemed to have been duly served if delivered by hand when left at the address of the other; if given or made by prepaid first class post, 48 hours after being posted (excluding Saturday, Sunday and public holidays).

 

Changes to legal notices

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

 

Law, jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

 

Data Protection

Bellatrix Health and Safety Limited are registered under the Data Protection Act 1998.  Your contact details as supplied to us will not be passed on to third parties except to the extent necessary to administer your course.  The information may also be used for marketing purposes and you may be contacted by telephone or e-mail with details of future similar events and courses organised or promoted by Bellatrix which may be of interest to you.  We will not send our marketing communication to any individual or organisations who have requested that their details are not used for such purposes. 

 

We take appropriate physical, electronic and managerial measures to ensure that we keep your data secure, accurate and up to date, and that we only keep it as is reasonable and necessary. If Personal data is disclosed, the Service Provider will ensure the bodies/organisations to which the Personal data is disclosed maintain equivalent measures and processes.

 

We endeavour to take all reasonable steps to protect your personal information.  However, we cannot guarantee the security of any data that you disclose online and we will not be responsible for any breach of security unless this is due to our negligence or wilful default.

 

You have the right to see personal data (as defined under the Data Protection Act) that we keep about you upon receipt of a written request and payment of an administration fee of £10.00.  Any request should be sent to: Data Protection Officer, Bellatrix Health and Safety Limited, PO Box 400, Sutton, Surrey. Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
